Tenant will be released from his/her lease obligations under the following circumstances:
Tenant must provide 60 day written notice, said notice becoming effective on the first day of the month following the date of notification. Any notice, when mailed, will be considered delivered on the date of the postmark from the U.S. Postal Service. If emailed or faxed, we will go by date received substantiated by a confirmation receipt. If not mailed, any notice will be considered delivered when delivered to the proper address during business hours and acknowledged in writing as received.
At the time notice is given, an early lease termination is due to the Landlord of money equivalent to one month’s rent, as liquidated damages (Early Lease Termination Fee). Payment must accompany the 60-day written notice as discussed above for the written notice to be valid. Monthly rent payments, excluding any adjustments for concessions, must be made when due for a minimum of two months after notice is received and a maximum of the full term of the lease or until the unit is re-rented. If we are unable to re-rent your apartment prior to your original lease expiration date, the lease termination fee will be applied to your last month’s rent. Non payment and/or late payment will result in the revocation of right to vacate and Tenant must fulfill the original terms of the Lease. If resident vacates, resident remains responsible for all utilities and rent until the apartment is re-rented. Any monies paid for the 60-day period, whether or not resident vacates, is to be considered liquidated damages and not rent, even if the unit is re-leased. ___Initial
There will be an additional charge for any damages other than reasonable wear and tear as per your Lease Agreement. If occupancy in your apartment is for eight months or less, Tenant is responsible for all costs of painting, shampooing, and redecorating the apartment. ____Initial
If any concession specials were given at lease conception or renewal, and all the terms of such lease were not fulfilled, the total concession must be repaid at the time of lease termination notice for notice to be valid. All future concessions will become null and void.
No notice of termination will be considered by management unless the Tenant is current in all payments due under his lease, including rent, late charges, utility charges, or any other charges.
I understand I entered into a Lease until ________ and it is not the Landlords responsibility to rent my apartment before Landlord’s vacant apartments. ____Initial
